As regards the details of the Ordinance, I think it would have been better if power had been given to the police to prevent summarily, during the night, the intolerable game of "Chai-chui".
It appears to me that Section ... carries the law no further than it was before; for Ordinance No. 4 of 1844, though nominally directed against noisy Watchmen, gives remedy by summons against any "person whatsoever" who shall, between sunset and six in the morning, make any noise whatever calculated to disturb the quiet of any occupier of a dwelling house.
This law has proved ineffectual because persons who have been kept awake half the night by Chai Mai are too busy the next day (or find it too difficult) to trace and summon the offenders.
The only effectual remedy, in my opinion, would be to deal with the offenders "flagrante delicto," that is, to instruct and empower the police...
